End User License Agreement (EULA)

1. Legal Agreement & License Grant

This End User License Agreement ("EULA") is a legally binding contract between you ("End User", "Licensee", "Parent", or "Guardian") and Cognito Parental Control ("Cognito", "we", "us", or "our") regarding your use of the Cognito Android IoT Client software, APK binaries, mobile applications, and associated web dashboard infrastructure (collectively, the "Software").

By purchasing the ₹999 lifetime license, downloading the Cognito APK, or installing the Software on any device, you agree to be bound unconditionally by the terms of this EULA. If you do not agree to these terms, do not install or utilize the Software.

Cognito grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable lifetime license to install and execute the Software strictly for personal, non-commercial parental monitoring of child devices within your immediate family household.

2. Intellectual Property & Software Ownership

The Software is licensed, not sold, to you. Cognito and its licensors retain all right, title, ownership, and interest in and to the Software, including all underlying source code, binary executables, proprietary algorithms, UI/UX designs, trade secrets, copyrights, patents, and trademarks.

Your license confers no title or ownership in the Software and is not a sale of any rights in Cognito's intellectual property.

3. Strict License Restrictions & Prohibited Acts

You agree that you shall not, under any circumstances, engage in or permit any third party to engage in any of the following prohibited activities:

  • Reverse Engineering: Decompiling, reverse engineering, disassembling, or attempting to derive the source code, underlying ideas, or encryption algorithms of the Cognito Android IoT Client APK.
  • Modification & Derivation: Modifying, adapting, translating, or creating derivative works based upon the Software.
  • Redistribution & Sub-licensing: Selling, renting, leasing, sublicensing, distributing, or offering the Software as a commercial service or bureau deployment to third parties.
  • Circumvention of Security: Bypassing, modifying, or disabling any licensing verification, SSL certificate pinning, or cryptographic security mechanisms integrated within the Software.
  • Automated Scraping: Using automated scripts, scrapers, or benchmarking utilities to analyze Software performance or reverse-engineer API communication protocols.

4. Consent to Use of Diagnostic & Technical Data

You agree that Cognito may collect, maintain, and process anonymous technical diagnostic data, crash logs, error reports, and device compatibility metrics gathered periodically from the Software. This data is utilized strictly to troubleshoot software bugs, ensure operating system compatibility, and deliver critical security patches. This diagnostic telemetry contains no personal identifying information or child monitoring data.

5. Termination & License Revocation

This EULA is effective until terminated. Your rights under this EULA will terminate automatically and immediately without notice from Cognito if you fail to comply with any provision of this EULA or our Terms of Service (such as attempting unauthorized surveillance of an adult).

Upon termination, you must immediately cease all use of the Software and completely uninstall and destroy all copies of the Cognito Android IoT Client APK from all devices in your possession.

6. Limitation of Liability & Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COGNITO BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF COGNITO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Enforcement of Liability Cap

COGNITO'S ENTIRE, CUMULATIVE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE STRICTLY LIMITED TO AND CAPPED AT THE EXACT AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE LICENSE, SPECIFICALLY ₹999 (NINE HUNDRED AND NINETY-NINE INDIAN RUPEES).

You agree to indemnify and hold Cognito harmless from any claims, damages, or lawsuits arising from your improper installation, execution, or deployment of the Software.

7. Governing Law & General Provisions

This EULA shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under this EULA shall be brought exclusively in the courts located in New Delhi, India.

This EULA constitutes the entire agreement between you and Cognito concerning the licensing and execution of the Software binaries.
